Hurt introduces SHORE act to protect lake landowners’ rights

WASHINGTON, D.C. – Fifth District Congressman Robert Hurt (R-VA) this week introduced the Supporting Home Owner Rights Enforcement (SHORE) Act in the U.S. House of Representatives.

The act will require the Federal Energy Regulatory Commission to take into account private property ownership rights when issuing and enforcing hydropower project licenses.

Companion legislation has been introduced in the U.S. Senate by U.S. Sen. Roy Blunt, a Republican from Missouri.

“As the federal government continues to expand in size and scope, we must ensure that Central and Southside Virginians and all Americans are not negatively affected by its over-reach, especially as it relates to individuals’ right to own and enjoy private property,” said Hurt.

The SHORE Act will require that the Federal Energy Regulatory Commission take into consideration private property rights when exercising its authority at Smith Mountain Lake and other federally regulated hydro-projects.

Additionally, it will require that licensees consider the benefit of private landownership to investment and increased tourism when developing recreation resources within a project boundary.

“Federal government regulations have rapidly expanded in reach in the past decade, and this is but one example of that expansion,” said Hurt.

“I appreciate the engaged citizens at Smith Mountain Lake, and in Bedford, Franklin, and Pittsylvania counties for bringing this important issue to my attention and I look forward to working with my colleagues in the House and the Senate to address this issue.”

Franklin County Board of Supervisors member Russ Johnson, chairman of the Tri-County Relicensing Committee, praised Hurt’s bill.

“The SHORE Act is not only of great benefit to the 240,000 people that live in the counties that encompass Smith Mountain and Leesville lakes, it is of benefit to private property owners throughout the United States who seek, as we do, to balance environmental stewardship and recreational enhancement with private property and the rights that go with ownership,” said Johnson.

“The noble goals of this legislation go a long way towards fairness and responsibility, which are at the core of our nation and of our government’s proper relationship with its citizens.”

Online petition seeks action against FERC

The ongoing efforts by local group Cut Unnecessary Regulatory Burden (CURB) to make changes to Appalachian Power’s current Shoreline Management Plan is starting to gain some attention nationally.

An online petition started by CURB president Bill Brush is receiving signatures from residents from all over the country.

The petition is one of many on the We the People website that can be found at WhiteHouse.gov. The site was set up to give people the opportunity to encourage the Obama Administration to take action through signatures. According to the site, if a petition gets enough signatures it is reviewed by White House staff and sent to policy experts to issue an official response.

So far the site has gained over 1,000 signatures since the online petition was started on Sept. 28. Signatures from residents in several states, as well as several in Virginia can be found on the petition website.

According to Brush, these out of state signatures are from people who are dealing with the same issues as local residents. There are other versions of the Shoreline Management Plan enforced by public and private utilities all over the country, Brush said. Overseeing all these plans is the Federal Energy Regulatory Commission (FERC).

“This is not just a Virginia problem,” Brush said.

Other localities have taken notice to CURB efforts. Residents from Washington and Oklahoma have contacted Brush with interest in attending his next CURB meeting scheduled for sometime in November.

Until then, Brush is trying to get as many signatures as possible. He would like to obtain 5,000 signatures before the site is taken down. Each petition site remains active for only 30 days.

New nonprofit opposes APCo shoreline management plan

Cut Unnecessary Regulation Burden Inc., a newly formed nonprofit that opposes Appalachian Power Company’s plan for shoreline management at Smith Mountain Lake, will meet Thursday night.

CURB held its first meeting in July to rally support for fighting APCo’s plan that regulates development and growth at the lake.

Members believe the plan violates property rights and is burdensome.

The power company, through a license from the Federal Energy Regulatory Commission, operates a hydro pumped storage project that utilizes the lake and Leesville Lake for generating electricity.

CURB has invited all lake area residents to attend Thursday’s 6 p.m. meeting at the Moneta Library on Virginia 122 in Bedford County.
